As You Like It Rugby Tours — Booking Terms and Conditions

These terms govern your booking with As You Like It Rugby Tours for all tours. Please read them carefully before you place a deposit. By placing a deposit you confirm that you have read, understood, and agree to be bound by these terms on behalf of yourself, and that you are 18 years of age or older.


1. Who you are contracting with

As You Like It Rugby Tours is a trading name of Ketchup Social Inc, a corporation registered in the State of Delaware (file number 10220530), with its registered office at 1007 N Orange St, 4th Floor, Suite 1382, Wilmington, New Castle County, DE 19801 (registered agent: Free Agent LLC, at the same address). In these terms, "we", "us", and "our" mean Ketchup Social Inc trading as As You Like It Rugby Tours. "You" and "your" mean the individual participant placing a booking. Your tour contract is with Ketchup Social Inc.

2. Eligibility

Our tours are sold to participants aged 18 or over. By booking you confirm you are 18 or older. We do not knowingly accept bookings from anyone under 18.

3. How a booking is made

3.1 You make a booking by completing the sign-up form on the relevant tour page and paying the deposit. Doing so is an offer by you to book on these terms.

3.2 Your booking is a request until we confirm it. We acknowledge receipt of your deposit by email. That acknowledgement is not confirmation of the tour itself (see clause 7).

3.3 You are responsible for ensuring the information you give us — name as it appears on your passport, contact details, dietary and medical information, and any other details we request — is complete and accurate, and for telling us promptly if anything changes.

4. Your deposit

4.1 A deposit of $50 per participant secures your place.

4.2 The deposit is refundable, less any card processing fees we have incurred, at any time before the tour is formally confirmed under clause 7.

4.3 Once the tour is formally confirmed, your deposit is applied toward your total tour cost and is no longer separately refundable. From that point, the cancellation terms in clause 8 apply to all monies paid, including the deposit.

5. Tour price

5.1 The price range for each tour is shown on its tour page. The final total tour cost is fixed and communicated to you when the tour is confirmed.

5.2 Prices are in US dollars unless stated otherwise on the tour page.

5.3 Once your total tour cost is confirmed, we will not increase it except where there is a change in government-imposed taxes or fees, a significant change in currency exchange rates affecting committed overseas costs, or a change you request. We will always tell you before any increase takes effect, and where an increase exceeds 8% of the tour price you may cancel and receive a refund of monies paid for the affected portion, less the deposit and any non-recoverable third-party costs already committed on your behalf.

6. What is and is not included

6.1 What your tour price includes and excludes is set out on the tour page. Read it carefully.

6.2 Unless expressly stated on the tour page, the price does not include: international and domestic flights, travel insurance, the UK Electronic Travel Authorisation (ETA) or any visa, passport costs, airport transfers not listed in the itinerary, personal spending, meals not listed, and anything described as optional or as an add-on.

7. Tour confirmation and minimum numbers

7.1 Each tour requires a minimum number of confirmed participants to proceed. Until that minimum is reached and key suppliers are committed, the tour is not confirmed.

7.2 We will tell you when the tour is confirmed. If a tour does not reach its minimum numbers and we decide not to operate it, we will tell you and refund all monies you have paid, including the deposit, less any card processing fees. That refund is the full extent of our liability to you in that situation.

8. Paying the balance

8.1 Once the tour is confirmed, the balance of your tour cost is collected in instalments according to the schedule we communicate to you. The final instalment is due no later than one month before departure.

8.2 Depending on how a tour is configured, either (a) you authorise us to charge your saved payment method automatically on each scheduled instalment date, or (b) we email you a secure payment link approximately five days before each instalment date for you to pay. The tour page or your confirmation will tell you which applies.

8.3 Where you have authorised automatic instalments, that authorisation continues until your balance is paid in full or your booking is cancelled. You may withdraw the authorisation by contacting us, but you remain responsible for paying each instalment by its due date by another method.

8.4 If you do not pay an instalment by its due date and do not resolve it with us within a reasonable period after we contact you, we may treat your booking as cancelled by you, and the cancellation terms in clause 8.5 will apply.

8.5 Cancellation by you. If you cancel after the tour is confirmed, the date we receive your cancellation in writing determines the refund:

8.6 These retained amounts reflect costs we commit to suppliers on your behalf well ahead of departure, which we cannot recover. They are a genuine pre-estimate of our loss, not a penalty.

9. Changing your booking and player swaps

9.1 If you want to change your booking, tell us in writing. We will do our best to help but are not obliged to make changes, and changes may incur the third-party costs charged to us plus a reasonable administration fee, which we will tell you before applying.

9.2 You may transfer your place to a replacement participant up to the name-swap deadline (typically two weeks before departure, confirmed for each tour). You arrange the replacement, the replacement agrees to these terms, you remain responsible for any sums outstanding until we confirm the transfer, and we update the manifest. Some third-party costs (for example name changes on tickets, where transferable at all) may not be recoverable and will be passed on.

10. Changes or cancellation by us

10.1 We plan tours many months ahead and firm up details across the planning window. We may make reasonable changes to activities, venues, timings, accommodation of an equivalent standard, and fixtures where circumstances require it. We will communicate changes promptly and aim to preserve the overall character and value of the tour.

10.2 If we have to make a significant change to a confirmed tour (a material change to its essential character) and you do not accept it, you may cancel and we will refund the monies you have paid for the affected portion, less the deposit and any non-recoverable third-party costs already committed on your behalf. Where the change or cancellation is for a reason within our reasonable control and not caused by force majeure, we may also offer reasonable alternative arrangements.

10.3 We are not liable to pay compensation where a change or cancellation is caused by force majeure (clause 11) or by the minimum numbers not being met (clause 7).

11. Force majeure

11.1 We are not liable for any failure or delay in performing our obligations, or for cancelling or changing a tour, where this is caused by events beyond our reasonable control. These include but are not limited to: war, threat of war, civil unrest, terrorism, government action or travel restriction, border closure, epidemic or pandemic, natural disaster, severe weather, fire, flood, industrial dispute, airline or transport provider failure or insolvency, and cancellation or rescheduling of a sporting fixture or event by its organiser.

11.2 Where a tour is affected by force majeure, we will refund the monies you have paid, less any third-party costs we have committed on your behalf and cannot recover. We will use reasonable efforts to recover and pass back to you any refunds we obtain from suppliers. This is the full extent of our liability in a force majeure event.

11.3 You are strongly advised to hold travel insurance that covers cancellation and disruption, including for the categories of event described in this clause.

12. Your money

12.1 Participant deposits and payments are held in a separate company account and are not commingled with personal funds. They are drawn down to pay confirmed suppliers for your tour.

12.2 We arrange tour-specific general liability cover before committing supplier deposits for a confirmed tour.

12.3 We are not a member of a bonding scheme such as ABTA or ATOL (which are UK schemes) and we are not an IATA agent. Your financial protection is the separate-account arrangement described above and your own travel insurance. Nothing in these terms affects any protection you may have through your card issuer.

13. Travel insurance

13.1 Travel insurance is mandatory for every participant. You must hold a policy that covers, at minimum, medical treatment and repatriation abroad, trip cancellation and curtailment, and personal liability, and that does not exclude participation in rugby or contact sport.

13.2 Many standard travel policies exclude contact sport. It is your responsibility to confirm your policy covers playing rugby. We can provide a vetted partner on request. We are entitled to ask for evidence of adequate insurance before departure and to refuse participation in the playing element of the tour without it.

14. Health, fitness, and your responsibility to participate safely

14.1 You confirm you are physically fit to participate in the tour, including any rugby you choose to play, and that you have no medical condition that makes your participation unsafe without having disclosed it to us and, where relevant, to your own doctor.

14.2 You are responsible for disclosing dietary requirements and any medical information relevant to your safety on tour. We will handle that information in line with clause 18.

14.3 You are responsible for your own conduct and for playing within the laws of the game and the reasonable instructions of match officials and organisers.

15. Assumption of risk, release, and indemnity

Please read this clause carefully. It affects your legal rights. By placing a deposit you agree to it, and before travelling you will also be asked to sign a separate Participant Waiver to the same effect.

15.1 You understand that rugby is a full-contact sport that carries inherent risks of injury, including serious injury, and in rare cases permanent disability or death. These risks include, without limitation, sprains, fractures, dislocations, concussion and other head and neck injuries, muscle and ligament damage, and the more remote risk of catastrophic injury. These risks cannot be eliminated regardless of the care taken.

15.2 You acknowledge that the tour may also involve travel, social activities, and excursions that carry their own ordinary risks.

15.3 You voluntarily choose to participate with full knowledge of these risks, and you accept and assume all such risks, whether or not they are foreseeable.

15.4 To the fullest extent permitted by law, you release and agree not to sue Ketchup Social Inc, its officers, directors, employees, agents, and contractors (the "Released Parties") in respect of any loss, injury, illness, or damage arising out of your participation in the tour or any activity within it, where that loss arises from an inherent risk of the activity or from ordinary negligence. This release does not apply to liability that cannot lawfully be excluded, including liability for death or personal injury caused by our gross negligence, recklessness, or willful misconduct, or any other liability that applicable law does not permit us to exclude.

15.5 You agree to indemnify the Released Parties against claims, costs, and liabilities arising from your own breach of these terms, your own negligence or misconduct on tour, or any injury or damage you cause to a third party.

15.6 If any part of this clause is held unenforceable, the remainder continues in full force.

16. Conduct on tour

16.1 You agree to behave in a way consistent with the reputation of your club and ours, to respect our hosts, suppliers, and fellow participants, and to comply with local laws and the reasonable instructions of organisers.

16.2 We may remove from the tour, at your own cost and without refund, any participant whose conduct in our reasonable opinion materially endangers themselves or others, damages property, or harms our relationships with hosts or suppliers. You are responsible for any damage or extra costs caused by your conduct.

17. Passports, visas, and travel documents

17.1 You are responsible for holding a valid passport, the UK ETA or any required visa, and any other travel documents required for the tour, and for meeting all entry requirements. We can point you to current guidance but we are not responsible for your failure to obtain or carry the correct documents, and no refund is due if you are refused entry or cannot travel for this reason.

18. Data and privacy

18.1 We collect and store your contact details, passport or identification details where required for travel, dietary and medical information you provide, rooming preferences, and payment records, in order to operate your tour and meet our legal and safety obligations.

18.2 We share the minimum necessary information with suppliers (such as accommodation, transport, and activity providers) to deliver your tour. We do not sell your data.

18.3 We keep your information only as long as needed for the tour and for any legal, accounting, or insurance requirement that follows it. Our full privacy policy is available at rugby-tours.com/privacy and sets out how we handle your data and your rights over it.

19. Complaints

19.1 If something goes wrong on tour, tell our representative or contact us at the time so we have the chance to put it right. If a problem cannot be resolved on tour, write to us at eddie@rugby-tours.com within 28 days of returning, with your booking details and a description of the issue, and we will respond and work in good faith to resolve it.

20. Limitation of liability

20.1 Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including for death or personal injury caused by our gross negligence, recklessness, or willful misconduct, or for fraud.

20.2 Subject to clause 20.1, we are not liable for loss or damage that was not reasonably foreseeable, for loss arising from your own breach of these terms, or for matters within clause 11 (force majeure), clause 7 (minimum numbers), clause 13 (your failure to hold adequate insurance), or clause 17 (your travel documents).

20.3 Subject to clause 20.1, our total liability to you arising out of or in connection with your tour, whether in contract, tort (including negligence), or otherwise, is limited to the total tour cost you have paid to us.

21. Governing law and disputes

21.1 These terms and any dispute arising out of them are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.

21.2 The parties submit to the exclusive jurisdiction of the state and federal courts located in New York for any dispute that is not resolved in good faith between them first. We commit to attempting good-faith resolution before any formal action.

22. General

22.1 These terms, together with the details on the relevant tour page and your booking confirmation, are the entire agreement between us about your tour and supersede any earlier discussions.

22.2 If any provision of these terms is held invalid or unenforceable, the rest continues in full force.

22.3 Our failure to enforce any provision is not a waiver of it.

22.4 We may update these terms from time to time. The version in force when you place your deposit is the version that applies to your booking.
